Automatia
Terms and Conditions
This is a translation. Only the Slovak version is legally binding.
1. Operator and description of the service
Automatia is a brand under which the platform is operated by P3M Automation s. r. o., registered office Doležalova 3424/15C, 821 04 Bratislava — Ružinov, Slovakia, company ID (IČO): 53 728 696, VAT ID: SK2121480185 (the “Operator”). Automatia is an online platform that brokers contact between companies looking for industrial automation specialists (“Companies”) and independent freelancers/contractors offering their services in this field (“Freelancers”).
2. Automatia is not a contracting party
Automatia only brokers the contact. Any contract or agreement on price, scope of work, quality, deadlines or payment between a Company and a Freelancer is made exclusively between them, outside the platform. Automatia is not responsible for the quality, correctness or timeliness of work performed by a Freelancer, nor for the conduct, payment discipline or trustworthiness of a Company. Any disputes are resolved between the Company and the Freelancer.
3. Registration and account
Using the platform requires registration and consent to these terms. The user is responsible for the accuracy of the information provided, including the company registration number, qualifications and certificates. Automatia reserves the right to verify, approve, reject or remove a profile or listing at its own discretion.
4. Account security
The user must protect their login credentials against misuse and must not share them with third parties. The user is responsible for all actions performed under their account until they promptly notify Automatia of any suspected misuse of the account (for example at dzurik@p3m-at.com). Automatia is not liable for damage caused by misuse of login credentials resulting from the user’s breach of this obligation.
5. Prices and payments
Current prices are always stated on the platform and exclude VAT, which is added at the rate applicable to the Company (the domestic rate or the reverse-charge mechanism for companies from other EU member states). The first project listing is free and tied to the Company’s registration number — it can be used only once per registration number, regardless of the number of user accounts. A Freelancer may optionally pay to feature their profile for 30 days; the basic profile always remains free of charge.
6. No refunds
Payments for unlocking a Freelancer’s contact details and for featuring a profile are non-refundable. When a contact is unlocked, Automatia provides a verified contact (at least a confirmed e-mail address) but does not guarantee that the Freelancer will respond — this is beyond the platform’s control and responsibility. For a featured profile, Automatia does not guarantee any specific number of views, clicks or resulting enquiries.
7. Intellectual property in content
Freelancers and Companies remain the owners of the content they upload to the platform (profile, portfolio, listing description). By uploading content, they grant Automatia a licence to display it on the platform and for related promotional purposes, such as indexing by search engines. The user is responsible for holding the rights to all uploaded content (including photos, logos and texts) and will compensate Automatia for any damage arising from the infringement of third-party rights in content they uploaded.
8. Prohibited conduct
In particular, it is prohibited to create duplicate accounts to circumvent limits (for example the free first listing), to provide misleading or false information in a profile, and to circumvent the platform’s paid features in order to avoid a fee.
9. Immediate termination for breach
Automatia may suspend or cancel, without notice, the account of a user who breaches these terms (in particular point 8), provides false information, damages Automatia’s reputation or acts contrary to good morals or applicable law. Cancellation of the account does not affect Automatia’s claim to payments already due, nor does it entitle the user to a refund of amounts already paid.
10. Account deletion and data retention
A Freelancer may delete their account at any time. Data to which a Company gained access before the deletion (by unlocking or through an application) remain available to that Company for 30 days after the account deletion, clearly marked as belonging to a deleted account. After this period, contact details and attached documents are permanently removed from the system, including the Company’s history. Payment and invoicing records are retained for the statutory periods regardless of this deletion.
11. Limitation of liability
Automatia strives to ensure the availability and functionality of the platform but does not guarantee uninterrupted, error-free operation. Automatia’s liability towards users is limited to the maximum extent permitted by applicable law.
12. Changes to the terms
Automatia may amend these terms from time to time; it will inform users of material changes by e-mail or by a notice on the platform.
13. Transfer of rights and obligations
The Operator is entitled to transfer its rights and obligations under these terms (including the entire Automatia platform, the contractual relationships with Companies and Freelancers and the related personal data) to a third party, for example in the event of a sale of the platform or part of it, or a merger or reorganisation of the Operator. Users will be informed of such a transfer in advance. By continuing to use the platform after being informed, the user agrees to the transfer; if they do not agree, they may delete their account before the transfer.
14. Governing law
These terms and the relationship between Automatia and the user are governed by the laws of the Slovak Republic. Disputes fall within the jurisdiction of the courts of the Slovak Republic.
